Nataša Petrović Tomić završila je Pravni fakultet Univerziteta u Beogradu, sa prosečnom
ocenom 9,87, i proglašena za studenta generacije.
Poslediplomske studije upisala je 2003/04. na Pravnom fakultetu Univerziteta u
Beogradu (Smer za privredno pravo). U periodu od 2003. do 2005. sarađivala je kao istraživač
pripravnik sa Institutom za uporedno pravo na osnovu stipendije Ministarstva nauke i zaštite
životne sredine za 200 mladih talenata za magistarske studije i njihovo uključivanje u
naučnoistraživačke projekte. Raspoređena je na naučnoistraživački projekat „Harmonizacija
jugoslovenskog prava sa privrednim pravom Evropske unije i standardima Saveta Evrope“. Od
2004. do 2005. godine bila je asistent-pripravnik na Pravnom fakultetu Univerziteta Union na
predmetima Katedre za građansko pravo.
Na mesto asistenta-pripravnika za naučnu oblast Poslovno pravo – predmet Pravo
osiguranja izabrana je 2005. godine. Držala je vežbe i iz Trgovinskog i Kompanijskog prava.
Obavljala je funkciju sekretara Katedre za Građansko pravo u periodu od 2005. do 2007.
godine; bila je sekretar specijalističkih studija za Notarsko pravo, kao i član više stručnih
komisija na Fakultetu. Jedan je od osnivača Udruženja naučnika i istraživača u oblasti pravnih
studija, čiji je osnovni cilj harmonizacija prava u regionu jugoistočne Evrope sa pravom EU i
opštim principima međunarodnog prava – HARMONIUS, i direktor Studija za potrošačko pravo
i pravo osiguranja pri Udruženju. Učestvovala je u radnom timu Privredne komore Srbije za
izradu Kodeksa poslovne etike.
Član je Upravnog odbora Udruženja pravnika u privredi Srbije, član redakcije časopisa
Pravo i privreda, uređuje rubriku Novosti iz sveta osiguranja u časopisu Pravo i privreda, član je
redakcije časopisa Harmonius, član je Redakcijskog odbora časopisa Tokovi osiguranja, član je
Uređivačkog odbora časopisa Harmonius. Bila je recenzent većeg broja naučnih radova, između
ostalih i za časopise: Anali Pravnog fakulteta u Beogradu, Pravo i privreda, Pravni život, Tokovi
osiguranja, Evropska revija za pravo osiguranja, Zbornik Pravnog fakulteta Sveučilišta u Rijeci,
Zbornik Pravnog fakulteta Sveučilišta u Osijeku, Anali Pravnog fakulteta Univerziteta u Zenici.

Predavala je na specijalističkim kursevima iz oblasti poslovnog prava u Komisiji za
hartije od vrednosti. Bavi se konsultantskim poslovima. Autor je brojnih članaka iz oblasti
trgovinskog prava, prava osiguranja, poslovne etike, kao i korporativnog upravljanja.
Učestvovala je na mnogim međunarodnim i domaćim konferencijama.
Dvadesetog decembra 2006. godine odbranila je sa odlikom magistarski rad pod
naslovom „Osiguranje robe u međunarodnom pomorskom prevozu“, koji je objavljen 2009.
godine.
Dobitnik je stipendije za doktorske studije na Max Planck Institut für ausländishes und
internationales Privatrecht u Hamburgu za period jul–avgust 2008. godine. Ponovo dobija
stipendiju za istraživački boravak na Max Planck Institutu u julu 2015. godine, kao i u julu 2018.
godine.
Sedmog februara 2011. godine sa odlikom je odbranila doktorsku disertaciju pod
nazivom „Osiguranje od odgovornosti direktora i članova upravnog odbora akcionarskog
društva“. Iste godine izabrana je za docentkinju za Poslovnopravnu naučnu oblast.
Od 2015. godine član je tima Privredne komore Srbije, koji pod okriljem Narodne banke
Srbije, sprovodi edukaciju posrednika i zastupnika u osiguranju. Od 2015. predaje Pravo
osiguranja na pripremnom kursu za polaganje stručnog ispita za sticanje zvanja ovlašćenog
zastupnika u osiguranju i ovlašćenog posrednika u osiguranju u Privrednoj komori Srbije.
Takođe, učestvuje u izvođenju kontinuiranih obuka ovlašćenih posrednika u osiguranju i
ovlašćenih zastupnika u osiguranju i predaje teme koje je odobrila Narodna banka Srbije. Bila je
urednik Priručnika za sticanje zvanja ovlašćenog posrednika u osiguranju i ovlašćenog
zastupnika u osiguranju, koji je odobren od strane Narodne banke Srbije.
Školske 2017. godine imenovana je za člana komisije za polaganje ispita iz stranih jezika
radi upisa na doktorske studije (komisija za proveru znanja španskog i italijanskog jezika sa prof.
dr Bojanom Spaićem).
Bila je gostujući predavač na Pravnom fakultetu Univerziteta u Zenici od 2016. do 2018.
godine.

Prof. dr Nataša Petrović Tomić trenutno je uključena u naučnoistraživačke projekte
Ministarstva prosvete, nauke i tehnološkog razvoja, kao i strateški projekat Pravnog fakulteta
Univerziteta u Beogradu. Uključena je i u jedan međunarodni projekat. Naime, u toku
2019/2020. bila je konsultant na projektu Pravnog fakulteta Univerziteta u Ljubljani
„Modernizacija zakonske ureditve zavarovalne pogodbe“, pod vođstvom profesora Mihe Juharta,
koji je rezultirao usvajanjem Nacrta zakona o ugovoru u osiguranju, kojim će se Republika
Slovenija svrstati u red evropskih država koje ugovoru o osiguranju pridaju zasluženi značaj u
zakonodavnom smislu.
Govori engleski, španski, nemački i francuski jezik, a služi se i stručnom literaturom na
slovenačkom jeziku.

NEED TO IMPROVE SERBIAN INSURANCE REGULATORY FRAMEWORK BY ADOPTING INSURANCE CONTRACT LAW

          The author tries to answer whether the insurance contract is to be regulated under the Draft Civil Code of Serbia. Relying upon the result of a comparative legal analysis, the author advocates to the adoption of the Insurance Contract Law as one of the most important regulations in the process of harmonization of the Serbian law with that of the European Union. The adoption of a sectorial, special regulation is justified by a few arguments, of which the author highlights the bulkiness of insurance contracts, the peculiarities of the insurance contract compared to the rest of the contract law, the need for adopting an incentive regulatory framework for insurance clients and dynamics of the subject matter. Such a step does not exclude the regulation of insurance contracts under the provisions of the Civil Law. On the contrary, the author advocates for this, but recommends that the legislative technique and the scope of the matter need to be adapted to the twenty-first century and the nature of this significant contract. Namely, the Draft Civil Code needs to achieve two goals: lay the foundations for a new insurance regulatory framework under the Serbian law and strengthen the legal protection of more vulnerable contracting party. This is achievable through imperative and semi-imperative norms, whereas the issues governed by optional norms should remain the subject of a special insurance contract law. The norms of the Civil Code of Serbia should be general and systemic, and, as such, a necessary but not sufficient regulator of the 21st century insurance legal relations. Such norms will be amended, elaborated and particularized under the Insurance Contract Law. The author concludes by a general proposal as to which issues should be governed by this sectorial regulation.

UNFAIR CLAUSES IN INSURANCE CONTRACTS AND DRAFT SERBIAN CIVIL CODE

The author analyses the provision of the Draft Serbian Civil Code on unfair clauses in insurance. After the explanation of the term and of the importance of unfair clauses, the author presents the arguments in favour of this institute in the field of insurance. The subject provision of the Draft is analysed in the largest part of this paper. The author firstly points out the shortcomings in terminology used in the Draft, and subsequently analyses the provision. Despite her positive attitude to the attempts at creating the regulations on unfair clauses, the author highlights different arguable questions and the issue of non-compliance with the effective regulation on consumer protection. The author argues that unless the analysed deficiencies are remedied in the proposed manner, the efficient protection of the weaker contracting party will be challenged.

DUTY TO INFORM CONSUMER OF INSURANCE SERVICES IN GERMAN LAW

The author deals with the analysis of information duty in German law. Having in mind that German Insurance Contract Law adopts the so-called informative paradigm of protection of consumers of insurance services, one of the essential issues is which information should be given to the consumer before concluding the insurance contract as well as during validity of insurance contract. Apart from the provision of the Insurance Contract Law, the author analyses the Decree on duty to inform, which specifi ed the contents of the mentioned duty. The author advocates for the adoption of a very similar approach in Serbian law and adoption of the bylaw which would introduce the so-called list of information on insurance product and precisely defi ne the volume and the contents of information which should be given to the consumer of insurance services.

INSURANCE OF LAWYERS’ PROFESSIONAL LIABILITY - SERBIAN VERSION OF NEW FORM OF COMPULSORY INSURANCE

Although it has long been domesticated in comparative law, the institute of lawyers’ liability insurance is only recently (after adoption of the new Law on Advocacy) the part of our positive law. A new law regulates the lawyers’ liability insurance as a form of compulsory professional liability insurance and puts it in the section on rights and duties of lawyers. The paper is devoted to critical analyses of the provision of the said law that is introducing this very important kind of insurance into our country. Since the law only determines who is required to purchase this insurance, who is authorized to determine the minimum sums that must be bought, and what are the consequences of failure to meet such duty, the author expresses the opinion that such a provision is quite immature and it may become the source of problems in practical application. The introduction of the new type of insurance, especially if it is compulsory, requires the elements relevant for its implementation in practice to be determined as precisely as possible and legally defined. Therefore, the author seeks to open all the questions that may be disputable in the application of this provision and discredit the new types of insurance in the eyes of both lawyers and public. The biggest part of the paper is dedicated to the analyses of the issues that may arise in the practice of lawyers’ liability insurance: who is obliged to conclude this insurance and the time when it must be fulfilled, who are the contracting and the other parties to the contract, who are the third injured parties, the direct action rule, the form of the contract, the extent of coverage, who are the persons whose liability may be covered by this insurance, what is the insured event, the minimum sum of the coverage, losses that may be excluded from the coverage, and so on. The author believes that the lawyers’ liability insurance is crucial for the further developement of the lawyers’ profession in our country, as well as for providing legal services in line with EU standards.
