Jasna Pak graduated from the Faculty of Law in Belgrade in 1970, passed the specialist exam in insurance in 1974, and the bar exam in 1976. In 1983, she earned her master's degree at the Faculty of Law of the University of Belgrade with the thesis entitled Nuclear Risk Insurance, and defended her doctoral thesis Product Liability Insurance and Defective Products in 1995, at the same faculty.

She began her research work in the field of insurance at the Research and Development Department of the Association of Property and Personal Insurance "Dunav", where she was employed in 1973, and in 1989, she moved to the Federal Directorate for Commodity Reserves - Insurance Department, and also closely focused her work on that line of business. From 1989 to 1993, she was the head of the Bureau of the International Insurance Card at the Association of Insurance Companies of Yugoslavia.

She became a research associate at the Institute for Comparative Law in Belgrade in 1995, and as of 2003, she lectured as an assistant professor on the subject of Insurance Law at the Faculty of Banking and Trade of the BK University. Since 2005, she has been an associate professor of Insurance Law and Fundamentals of Insurance at Singidunum University in Belgrade, where she was also a Vice Dean and head of the Insurance Department. Since 2008, she has been teaching Intellectual Property Law at the University Sinergija in the Federation of Bosnia and Herzegovina.

Professor Jasna Pak, PhD is the author of numerous scientific and professional papers published in journals and other publications of national and international importance, as well as of the textbooks Insurance Law and Fundamentals of Insurance.

She has been a member of the Expert Committee of the Yugoslav Nuclear Pool, a member of the Managing Board of the Serbian Association of Jurists, a member of the Managing Board of the Association for Insurance Law - a section of the International Insurance Law Association (AIDA), a manager and participant in numerous projects of the Institute of Comparative Law in Belgrade and one of the authors of the monographs of that Institute, as well as a notable participant in numerous scientific and professional conferences in Serbia and abroad.

As the editor-in-chief of the journal Insurance Law Review, she contributed to its reputation and quality with her extensive scientific knowledge and experience, whereas as a member of the editorial council or the editorial board, she greatly influenced the journals Insurance of Associated Labour (predecessor of Insurance Trends) and Yugoslav Law. She is a prominent member of the Editorial Council and a respected and highly valued reviewer of the journal Insurance Trends.

In 2013, she received Lifetime Insurance Achievement Award from the Association for Tort Law for her contribution to the development of insurance industry in Serbia.

She speaks French, English and German.

CONTRACT ON INSURANCE FOR THE ACCOUNT OF THIRD PARTIES OR FOR WHOM IT MAY CONCERN

Contracting insurance for the account of a third party other than the Policyholder is an exception from the general rule that the contract is effective only between the contracting parties. Different lines of insurance have specific characteristics, making a contract for account of third parties very complex. Provisions of the Law on Contracts and Torts governing the insurance for the account of third parties or for whom it may concern are general, which causes a confusion because, according to their inherent clauses, they are more appropriate for the insurance of property than the civic legal liability and personal lines. The insurance for the account of third parties may be effected for both property and personal lines, because the general provisions need to be applicable to both insurance groups. In the Preliminary Draft of the Serbian civil code, the provisions of the Law on Contracts and Torts regulating insurance for the account of third parties have not been amended, which is not a satisfactory solution. This paper analyses the most important issues in this insurance line and points to the need to amend the provisions of the Law on Contracts and Torts pursuant to the special traits of the insurance for the account of third parties in property and personal lines.

OBLIGATIONS, RESPONSIBILITIES AND PROFESSIONAL LIABILITY OF INSURANCE INTERMEDIARIES

Insurance mediation is very complex, so it is understandable to have a variety of questions, such as those relating to the legal nature of mediation contracts, the rules applicable to the intermediaries’ civil liability and liability insurance. Intermediary’s obligations that are legally established are such that they far exceed characteristic intermediary’s obligations in classical mediation contracts, which raises the question about the contract type. Specificity and complexity of the matter requires appropriate legal regulation of insurance intermediaries’ professional liability that would ensure legal certainty of intermediaries and other interested parties. The author points out that it is necessary to apply uniform conditions to insurance to provide minimum insurance cover. Insurance intermediaries’ professional liability is mandatory; therefore, it is not acceptable for insurance companies to conduct it based on conditions containing significant differences, especially with regard to exclusions from insurance that mostly limit it. The author points out that many of the questions raised during implementation of our regulations concerning insurance mediation cannot be answered without a good knowledge of the European Union law and the law of its Member States.

Obavezno osiguranje od građanske odgovornosti za štete iz upotrebe motornih vozila – Direktiva 92/49/EZ – Sistem bonus-malus – sloboda tarifiranja – referentna premija – državni nadzor poslovnih akata društava za osiguranje Odluka suda. Ne može se poistovetiti sistem davanja saglasnosti na tarife (što je suprotno principu slobode tarifiranja iz direktive 92/49) sa sistemom bonus-malus koji se primenjuje na ugovore o osiguranju od automobilske odgovornosti. Obavezni sistem bonus-malus nesumnjivo ima uticaj na premiju, ali nema za cilj to da država počne direktno da utvrđuje tarife jer društva za osiguranje mogu slobodno da utvrđuju visinu osnovne premije. Potpuno usaglašavanje u oblasti tarifiranja u neživotnom osiguranju koje isključuje svaku nacionalnu meru koja ima uticaj na tarife može da se smatra saglasnim s direktivom samo u slučaju da ona tako nešto izričito predviđa.

Ma koliko veliko, preduzeće koje u obavljanju delatnosti koristi motorna vozila (automobil, motor, radna mašina) treba da vodi računa o njihovom osiguranju. Osim obaveznih, osiguravači preporučuju zaključenje dobrovoljnih osiguranja koja odgovaraju posebnim potrebama preduzeća. Radi ograničenja rizika od saobraćajnih nezgoda moraju se poštovati neka pravila, naročito ona što se tiču preventivnih mera.

EXPIRED CLIAMS OF THE INSURED TOWARDS THE INSURER

Vrhovni sud Španije razmatrao je zahtev koji je D. Alfonso podneo za vanredno preispitivanje presude drugostepenog suda kojom je odbijen njegov zahtev da mu društva za osiguranje „Allianz S. A.“ i „Ocaso S. A.“ isplate 158.354,31 evro po osnovu osiguranja od građanske odgovornosti. Sud je odbio zahtev za vanredno preispitivanje presude, potvrdio pobijanu presudu, a podnosioca zahteva obavezao na naknadu troškova.
