PROVISIONS OF THE CIVIL CODE OF THE REPUBLIC OF SERBIA

The paper deals with the application of the principle of utmost good faith in insurance and the extent to which this principle is adopted in the Preliminary Draft of the Civil Code of Serbia. In addition, the protection of consumers in the capacity of insureds is considered together with the impact of this protection on the application of the principle of utmost good faith in insurance. Furthermore, the impact of EU directives in this area is analysed and, eventually, the question is raised whether the utmost good faith is still applied in insurance industry.
