GENDER IS (NOT) A FACTOR IN ACTUARIAL ANALYSIS

ABSTRACT

The European Court of Justice verdict from 2011. outlawed the Article 5 par. 2 of the Council Directive 2004/113/EC, thereby restricting insurers from taking into account gender while calculating the ammount of premiums and benefits. Enforcement of the former provision was qualifed as a mode of gender discrimination, and violation of the relevant provisions of the Charter of Fundamental Rights in the European Union. The insurers were obliged to introduce „gender neutral” motor insurance by 21st December 2012, and member-states have already made certain steps towards non- discriminatory pricing.
